Contest

The Fall 2021 Photo Contest for Rescue Dogs, Sponsored By The Burton Fletcher Foundation For Animals, Inc. http://www.BurtonFletcherFoundation.org, (the “Contest”) is open to legal residents of the U.S. who are at least eighteen (18) years old. Employees of The Burton Fletcher Foundation for Animals, Inc., and its affiliated companies (“Contest Entities”) as well as the immediate family (spouse, parents, siblings, and children) and household members, are not eligible to enter.

Participation in this Contest constitutes entrant’s full and unconditional agreement to the Official Rules and Sponsor’s decisions, which are final and binding regarding all matters related to the Contest. Winning first, second or third prize is contingent upon fulfilling the requirements set forth herein. This Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

By entering this photo contest, entrants agree to abide by and be bound by the Official Rules and Policies. Decisions of the Sponsor are final and binding in all respects. Winning the first, second or third place prize is contingent upon fulfilling all requirements set forth herein.

The Contest is currently open, and ends on December 15, 2021, at 12:00 p.m. Noon, EST.

Each entrant may submit only one (1) black-and-white and/or one (1) color photo (total of two photographs entered max).  All entrants who submit more than one (1) color and/or one (1) black-and-white photo will be disqualified.  All submitted entries will be credited, but become the property of the Sponsor, and are not returned.  Use of automated systems or of multiple accounts to enter the Contest is prohibited and will result in disqualification. Sponsor is not responsible for disqualified entries due to being lost, late, incomplete, invalid, unintelligible, or misdirected. Only previously unpublished photographs will be accepted (including, but not limited to all forms of social media, publications, and paid for print media).

Upon the Contest Period deadline, all entries will be judged by a panel of judges (to be selected by Sponsor in its sole discretion) based on the following judging criteria

• Creativity (40%)
• Fit to the Contest theme, “Happy Holidays!” (30%)
• Quality of Picture (30%)

In the event of a tie for a potential winner, the head judge will select the winner based on Creativity of the photo.

All entries must include the name, address, and phone number, and email address of the entrant, included in the email. Entries received without this information will be disqualified.

• Entries must be high-resolution (300 dpi) digital photos. Photocopies will not be accepted.
• The photo(s) submitted must be entrant’s original, nonprofessional, creation, owned solely by the entrant, and previously unpublished for payment.
• Entrant must have written permission from the owners of all dogs and any individuals that appear in the photo to use their name and likenesses and to grant the rights set forth herein. If requested, entrant must be able to provide such permissions in a form acceptable to Sponsor. Additionally, by entering this Contest, they warrant and represent that they are the owners of the photo submitted, have obtained all permissions necessary for Sponsor to display, post, publish or use the photo submitted as per the Official Rules and in promotional materials relating thereto including, but not limited to, permission for, property, copyrights, trademarks or other rights in materials or other items depicted in the photo submitted.
• The photo submitted must demonstrate the Contest theme, which is “Happy Holidays!”
• Photos submitted should not be disparaging, offending, threatening, defamatory, disparaging, or libelous. Nor should they contain any content that is unsuitable, indecent, sexual, profane, tortious, slanderous, prejudiced or promote hatred or harm against any group or person. Or otherwise not comply with the theme and joyful spirit of this Contest.
• Submitted photos must not contain material that infringes upon, infracts, misappropriates, any law or regulation or the rights of any third party including, but not limited to, any copyright, trademark or any rights of publicity or privacy, or any other intellectual property or proprietary rights.
• License to Use Entries: All entrants grant the Contest, its’ Sponsor and affiliates, perpetual, worldwide, transferable, fully paid, irrevocable, unconditional, and royalty-free, non-exclusive right and license for related entities or service providers to use the submission(s) and/or each element of an entrants’ entry. Such use may be (to): post, broadcast, distribute, copy, transmit, publish, reproduce, store display, or create derivative works of and/or otherwise use, in unlimited manner, for promotion of, or in connection with, the Contest. At the discretion of the Sponsor, in various and any media outlets/platforms, now or hereafter, such as social media pages and other digital media, newsletters, the Sponsor’s Web pages, television and other broadcast media, on third party sites, print materials, or for marketing and/or advertising.
• Upon submission, entrant agrees not to sue or assert any claim against the Contest or Sponsor for the use of any element of their entry and waives privacy/publicity rights, intellectual property rights, and/or other legal or moral rights that might preclude Sponsor’s use of any element of the entry.
• Sponsor is not required to pay any financial consideration or to seek any additional approval in connection with use of an entry. The display/publication of submitted photos on Sponsor’s website does not indicate the entrant is, or will be, selected as a winner.

• Winner Notification: The prize winners will be notified via email at the addresses provided on their entry form.  If the potential prize winners cannot be contacted within five (5) days after the date of the first attempt to contact them, or the prize is returned as undeliverable, they forfeit the prize and Sponsor reserves the right to award the prize to another entrant. 

• The prize winners must comply with all terms and conditions of these Official Rules as winning is contingent upon fulfilling all requirements.  The prizes will be fulfilled approximately 1-4 weeks after the conclusion of the Contest. By submitting to the Contest, entrants agree to the use of, by Sponsor its’ affiliates, and its designees, their names, photos and likenesses, and/or statements for advertising and promotional purposes, in perpetuity, via all forms of media, now known or hereafter devised (including and without limitation, the Internet), for this and/or similar promotions, including worldwide, without additional compensation except where prohibited by law. The prize winners agree to consent to such request in writing, upon request.

• Prizes: There will be one (1) First Place prize of $500; one (1) Second Place prize of $350; and one (1) Third Place prize of $150. Limit: one (1) prize per person. Prize winners are responsible for all taxes and fees, if any, associated with prize receipt.

• General Conditions: Sponsor reserves the right to suspend, modify, and/or cancel the Contest or any part thereof, if technical failures, human error, fraud, or any other factor impairs the integrity or proper functioning of the Contest, to which the sole discretion is to be determined by Sponsor. They also reserve the right to disqualify any submitting individual it finds has tampered with the entry process and/or the operation of the Contest or is found acting in violation of the Contest Official Rules, by inappropriate, unsportsmanlike, or in a disruptive manner. Any deliberate attempt by a person to undermine the legitimate operation of this Contest may be a violation of criminal and civil law, and should this type attempt occur, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. Sponsor’s failure to enforce any specific term of the Official Rules shall not constitute a waiver of that rule.

   

• Entrants also agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest and in no event shall they be liable for attorney’s fees. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
• Disputes: Excluding where prohibited, entrants agree that all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded (“Claims”) shall be resolved individually, without resorting to any form of class action, and exclusively by the appropriate court located in Valdosta, Georgia.
• All Claims, issues and questions regarding the structure, validity, representation and enforceability of these Official Rules, the rights and obligations of entrants, or the rights and obligations of the Sponsor in relation with the Contest, will be governed by, and construed in accordance with, all laws of the State of Georgia and the federal laws of the U.S.A. without giving consequence to any choice of law or conflict of law rules or provisions, which would cause the use of the laws of any jurisdiction other than the State of Georgia. Entrants agree: (1) all Claims, judgments and awards will be limited to actual out-of-pocket costs, but in no event including attorneys’ fees, disbursements, or court costs; and (2) under no condition will entrant be permitted to receive awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenditure.
• Collection and Use of Personal Information: By submitting to the Contest, entrants agree to Sponsor’s assemblage, use and disclosure of entrant’s personal information, and entrants agree that personal information submitted with an entry, including but not limited to their name, mailing address, phone number and email address may be gathered, processed, shared, disclosed, kept, maintained and otherwise used by Sponsor for the purposes of conducting and administering the Contest; for marketing intention by the Sponsor if entrant has opted-in to receive marketing communication from Sponsor; and for any other reason outlined in these Official Rules.
• Prize Winners List: For the prize winners list, you can send an email to photocontest@burtonfletcherfoundation.org with the subject line “2021 Shelter/Animal Welfare Dog Contest Photo Winners.” Prize winners list requests will only be accepted after the end of the Contest Period (listed above). Prize winners expressly agrees to Sponsor’s use of their name for this purpose.
